PRIVACY NOTICE

In accordance with the Personal Data Protection Act 2010 (“Act”), we, Genetix (“Genetix”), hereby give you notice (“Privacy Notice”) that the information you provide to us which relate to your personal data will be collected recorded, stored, held, used and/or processed in the manner and for the purposes as stated below. This Privacy Notice explains the type of data collected by us, the manner in which data is collected, the purposes of processing such data, the parties to whom we will be disclosing your data and the choices available to you, including how to access and correct such personal data.

Your Personal Data

Your data will be directly collected from you when you fill in the Patient Consent Form and when our services are engaged by you through your authorised requesting doctor, clinical geneticist or genetic counsellor and not from any other third party. Your data may include the following (“Personal Data”):

·         Full name, gender, date of birth, email address, identification card number and/or passport number, mobile number, landline number, home address; and

·         Biometric data in the form of blood and saliva as well as DNA extracted from the sample of blood and saliva provided by you (collectively, “sample”).

Non-provision of your Personal Data

In the event your Personal Data is not supplied or is insufficiently supplied to us, or if you withdraw your consent or restrict the purposes and methods in which we may process your Personal Data, we may not be able to provide and/or continue to provide our services to you, including for Genetic Testing Purposes.

Usage of your Personal Data

We may collect, record, store, hold, use and/or process your Personal Data for purposes of genetic testing which shall include, amongst others, to determine if you carry any gene alterations in the predisposition gene(s) for hereditary cancers.

Your genetic testing results may be used to help the counselling and testing of other family members of yours and any details of your identity or genetic testing results will not be revealed to them without your express consent.

Disclosure of your Personal Data

Your Personal Data and genetic testing results will be securely stored on an electronic database and will not be used by us for any purpose other than those specified above without your express consent.

The results of your genetic testing will be reported to you only through your authorised requesting doctor, clinical geneticist or genetic counsellor through whom you engaged our services.

Any information or data relating to your genetic testing will be held by us and will be known by those participating in providing the genetic test but will not be revealed or made available to any other person/organisation, except with your express consent or when disclosure is necessary under the law.

We will only make available your genetic testing results to the following class of persons identified by you in the Patient Consent Form:

·         any family member, individuals specified by you, doctor(s) specified by you and/or research groups specified by you.

In the event of your death, we will only release your genetic testing results to the person expressly named by you or uphold your said request that the results of your genetic testing not be revealed to anyone.

Where your Personal Data is transferred or disclosed to the aforesaid third parties, we will take reasonable steps to ensure that these third parties comply with our instructions and not use your Personal Data for any purposes other than those specified by us herein.

Access to and/or correction of your Personal Data

We will endeavour to ensure that your Personal Data collected, recorded, stored and/or held by us and/or disclosed to us is accurate, complete and up-to-date. Prompt notification of any changes to your personal contact details will aid us in achieving this.

You are entitled to access and/or request the correction of your Personal Data collected, recorded, stored and/or held by us where such data is inaccurate, incomplete, misleading or not up-to-date, upon payment of a prescribed fee, unless informed otherwise by us. Transferring your Personal Data abroad

We may transfer your Personal Data outside of Malaysia for purposes mentioned in this Privacy Notice.

Third Party Data

You hereby confirm that you have obtained the consent from the person(s) whose personal data may be given to us by you or identified from your Personal Data which may be processed by us for the purposes stated herein, including disclosure to the parties stated herein.

Your Consent

Please take note that by giving us your consent, you hereby agree with and consent to us processing/continuing to process your personal data in accordance with the terms herein.
